Abstract

This article discusses the problem of the improvement of the Codes of Conduct of the bailiffs of the Republic of Moldova and Romania so that they are able to guide the activity of enforcement of judicial decisions, in order to make it possible to effectively realize the subjective right and in cases of opposition of the debtor, to the fulfilment of the obligation contained in an enforceable title. The authors note the need to introduce in these codes the principle of rationality in the conduct of the bailiff. At the same time, they consider that it would be preferable to distinguish in these codes of ethics special chapters dedicated to in the structure of the code, which, of course, would be preceded by general provisions.
