Free movement of persons and services is more than just commercial objectives pursued by the Treaty of Rome. The two freedoms are in¬dis¬pensable for the exercise of European citizenship based on democratic principles expressed, in particular, in the European Convention on Human Rights (ECHR), to which the Community legal order subscribes. The freedom of communication, an essential freedom for all the citizens of the European countries, is found among all these principles. The freedom given to citizens of a Member State to exercise certain activities in another Member State is, obviously, other than to provide services to clients residing in another state outside the border.
Libera circulaţie a persoanelor şi a serviciilor reprezintă mai mult decît simplu obiectiv comercial urmărit prin Tratatul de la Roma. Cele două libertăţi sînt indispensabile în vederea exercitării unei cetăţenii europene întemeiate pe principiile democratice exprimate, în special, în Convenţia Europeană a Drepturilor Omului (CEDO), la care ordinea comunitară juridică subscrie. Printre aceste principii se găseşte şi acela al libertăţii de comunicare, libertate esenţială pentru toţi resortisanţii statelor europene. Libertatea de stabilire a cetăţenilor unui stat membru pe teritoriul unui alt stat membru pentru a exercita acolo anumite activităţi este, în mod evident, de altă natură decît aceea de a oferi, în afara frontierelor, servicii clienţilor rezidenţi în alt stat.
