Abstract: Several instruments of international law lay the “fair trial” principle as a fundamental in the civil procedure. The right to a fair trial is declared as a Human Right in many international Declarations. One of the most important of those Declarations in the European area is the European Convention on Human Rights, which establishes that everyone is entitled to a fair and public hearing within a reasonable time by an independent and impartial tribunal established by law.
