dc.description.abstractIn this article, the author, based on the democratic component guaranteed by the Constitution of the R. M. – THE SUPREME LAW OF THE SOCIETY AND THE STATE (Article 1, p. 3 and Article 7), brings up for discussion some gaps of the Education Code, which infiltrated inadvertently or through the „rush" of adopting this Code and can be understood differently by the actors of the Education Code implementation, and in some confusing cases may mislead those, who are responsible for the proper implementation of the Education Code in the society life. Also, it is suggested that the content of the Education Code should be modified according to the requirements of the legislation in force to overcome these shortcomings.en
